It is also a legal obligation carrying penalties for non-compliance. Once a fire alarm system has been installed, regular maintenance and servicing of the system is essential to ensure it will properly do its job when called upon and to comply with the ongoing legal requirements laid out in fire legislation. What are the Legal Obligations Relating to Fire Alarm System Maintenance?

The primary legislation governing fire alarm system maintenance is the Regulatory Reform (Fire Safety) Order 2005. British Standards BS 5839 provides helpful guidance on the minimum standards required to ensure compliance with the law.

The legal obligations relate both to testing – which you can carry out in-house – and service and maintenance, which need to be done by a professional. These are separate, distinct obligations.

BS 5839 recommends that fire alarms are routinely tested on a weekly basis. You can nominate a person within your organisation to carry out this testing. They will need to test at least one alarm each week, on rotation, and log the results. Weekly testing of this nature ensures that your system is in full working order, checks that everyone can hear the alarm and enables any issues to be identified and remedied at the earliest opportunity.

In addition to the recommended weekly testing, BS 5839 advises that a fire alarm system be thoroughly inspected twice a year. The inspection should be carried out by a BAFE-accredited professional with specialist knowledge of fire detection and fire alarm systems. The professional will methodically and thoroughly check the entire system to ensure it is in good working order and advise you of any issues. You will then need to implement any maintenance and repairs of the system in accordance with their findings. It is important to note that the twice-yearly interval is merely a guide; if premises are large or high-risk, more regular inspection and maintenance of the fire alarm system may be appropriate and four times a year is suggested.

Failure to comply with the relevant legislation can lead to a fine and, in some circumstances, a prison sentence.

Who is Responsible for Fire Alarm System Maintenance?

In non-domestic premises, all fire safety duties, including security fire alarm systems design installation and maintenance, fall to the person in control of the premises. That person will often be the employer but may also be the owner, landlord, building manager, managing agent or anyone else deemed to be in control.
